Terms and Conditions of Service

1. Introduction and Definitions

Welcome to Gugan UPVC Interiors. These Terms and Conditions ("Terms") govern the provision of interior design, manufacturing, and installation services by Gugan UPVC Interiors ("The Company", "We", "Us") to the client ("The Customer", "You").

By accepting a quotation, paying an advance, or allowing work to commence, you agree to be bound by these Terms.

2. Scope of Work

The scope of work is strictly limited to the items, designs, and specifications detailed in the final approved quotation and design drawings. Any additional works, modifications, or civil works (including but not limited to electrical, plumbing, tiling, or painting) are excluded unless explicitly stated in writing.

• Design drawings must be signed off by the Customer before manufacturing begins.
• The Company reserves the right to make minor technical modifications to improve structural integrity without prior notice.

3. Quotations and Pricing

All quotations are valid for a period of 30 days from the date of issue. Prices are subject to change based on fluctuations in raw material costs if the order is not confirmed within this period.

Unless otherwise specified, prices include material and installation costs but exclude applicable taxes (GST), transportation, and lifting charges for floors above the ground floor without elevator access.

4. Payment Terms

Strict adherence to payment schedules is essential for the timely delivery of your project. Our standard payment terms are as follows:

Delays in payment will result in equivalent delays in project timelines. The Company retains full ownership of all materials until the invoice is paid in full.

5. Delivery and Installation

Delivery timelines provided are estimates. While we strive to meet all deadlines, The Company is not liable for delays caused by Force Majeure events, supply chain disruptions, or lack of site readiness.

Customer Responsibilities for Site Readiness:

• The site must be clean, free of other debris, and have functioning electricity.
• Civil works (flooring, tiling, painting first coat) must be completed before installation begins.
• Secure storage space must be provided for materials once delivered.

6. Warranty Policy

We stand by the quality of our UPVC interiors. Our warranty covers manufacturing defects under normal residential use.

Exclusions:

• Glass, mirrors, and stone countertops are not covered under warranty.
• Damages due to misuse, water leakage from walls, pest infestation (unless specific termite-proof materials specified), or natural calamities.
• Normal wear and tear, scratches, or dents incurred after handover.

7. Cancellations and Returns

As all UPVC interiors are custom-manufactured to specific site measurements, confirmed orders cannot be cancelled or returned.

In the event of a cancellation request by the Customer after production has commenced, the Customer shall be liable for the full cost of materials and labor incurred up to that point, which may amount to 100% of the contract value.

8. Limitation of Liability

The Company shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the products. Our total liability shall in no event exceed the total amount paid by the Customer for the specific product or service in dispute.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
